1. Introduction
Welcome to Vizasound, a platform for creating and sharing short-form “jingles” (lyrics, music, and video). By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility & Account Registration
To create or save content you must have an account. You may register with an email and password or sign in with Google, Discord, or Apple single sign-on. Keep your credentials secure and notify us of any suspected compromise. The service is not intended for children under 16.
3. Your License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use Vizasound for personal, non-commercial purposes. You may not reverse engineer, scrape, harvest data, or circumvent security/quotas. We reserve all rights not expressly granted.
4. User-Generated Content (Ownership, Public/Private, and Licenses)
- Ownership: You retain ownership of the jingles and other content you create.
- Public vs. Private: You choose whether a jingle is public or private. Public jingles may appear on our site/app and may be distributed through sharing features and feeds (including third-party sites that embed or mirror feeds). Private jingles are not shown to the community or third parties.
- License you grant to us for Public content: A worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt to technical formats, publicly display, publicly perform, and distribute your public jingles and related metadata (e.g., title, cover image, username) in connection with operating, promoting, and distributing the service (e.g., partner feeds). We attribute public content to your username when displayed. This license lasts while the content is public and continues for a reasonable period to remove caches and copies.
- Private content: We host private jingles solely to provide the service to you; we do not distribute them publicly. Private jingles may be removed from our systems within 30 days of creation; please download anything you wish to keep.
- Third-party copies: If a jingle was public, it may have been downloaded or cached by others. We cannot guarantee removal from third-party sites or caches once distributed while public.
- License to other users: For public jingles you grant other users a personal, non-commercial license to view/stream and share via the platform’s provided features.
- Your responsibilities: You must have all rights needed for any content you upload or prompt, including images, audio, or video used in your jingles.
5. Content Rules (Usernames, Lyrics, Images & Video)
You may not post content (including usernames, lyrics, images, videos, tags, and prompts) that is illegal, infringing, deceptive, spammy, defamatory, hateful, harassing, violent, self-harm encouraging, sexually explicit or exploitative (especially involving minors), or that invades privacy or discloses personal data without consent. Impersonation and malicious code are prohibited. We may remove content or restrict accounts at any time, and repeat infringement may lead to termination.
6. Moderation & Community Reporting
Vizasound uses a combination of automated checks and human moderation. Logged-in users can report problematic content or bugs using the “Report” link at the bottom of any page. We may remove content, limit its visibility, or suspend accounts at our discretion to keep the community safe and the service reliable.
7. AI & Third-Party Services
To generate or enhance content you request, we route prompts and relevant inputs to third-party providers acting as our processors, including (without limitation) OpenAI and Google (lyrics/text and certain images), Mureka and MusicGPT (music), and Kling and Runway (video). Payments may be processed by providers such as Stripe and, where applicable, Apple or Google. Use of these services is subject to their policies; see our Privacy Policy and provider terms referenced there. We are not responsible for third-party outages or changes.
8. Credits, Pricing & Charges
- Some actions (e.g., generating lyrics, music, or video) consume credits. Current pricing is at our Pricing page.
- Purchased credits are valid for one year from the date of purchase.
- Free credits, including those from new account registration or promotional codes, are valid for 90 days from the date they are granted.
- When a feature has a cost, the price is displayed on the page (typically on the button). By clicking, you authorize us to deduct credits or charge the shown amount. Because we incur immediate third-party costs, orders cannot be canceled once generation starts.
- If a generation fails due to a system error, an automatic refund is applied. You can review your credit balance and transaction history (including automatic refunds) in My Credits. For payment issues contact support@vizasound.com.
9. Incomplete or Interrupted Jingles
If a job is interrupted (errors, timeouts, or you stopped), you can resume from My Jingles by opening the partial jingle. Additional processing may consume credits as indicated at the time you continue.
10. Access to the Service
- Viewing public content is free worldwide without an account.
- You must be logged in to create content or to like content.
- Recommendations may consider signals such as likes, views, tags, freshness, and other engagement; we make no guarantees that any content will be recommended or widely distributed.
11. Copyright Complaints (DMCA)
If you believe content infringes your copyright, email support@vizasound.com with: (a) your contact details; (b) a description of the work; (c) the URL of the allegedly infringing material; (d) a statement under penalty of perjury that you have a good-faith belief the use is not authorized; and (e) a statement that the information is accurate and that you are the owner or authorized to act. We may remove content and, where appropriate, notify the user.
12. Termination & Account Deletion
- You may close your account at any time from My Profile → Close account. Content on Vizasound’s servers is removed as described in our Privacy Policy.
- We may suspend or terminate accounts for violations. We are not obligated to refund unused credits upon termination for cause.
- We cannot guarantee removal of public content from third-party sites or caches that previously accessed it while public.
13. Our Intellectual Property
The service, software, and branding are protected by IP laws. You may not use our trademarks, logos, or UI assets without permission. You may not copy or modify the service except as allowed by law.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation or that content will meet your expectations.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIZASOUND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
16. Indemnification
You agree to defend, indemnify, and hold harmless Vizasound from any claims, losses, liability, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the service, or your violation of these Terms or applicable law.
17. Governing Law & Disputes
These Terms are governed by the laws of the State of California (without regard to conflict-of-laws rules). Any dispute will be resolved by binding arbitration in Alameda County, California, on an individual basis; you waive class actions and jury trials. You and we may seek injunctive relief in court to protect IP or security.
18. Changes to These Terms
We may update these Terms to reflect changes to our services or legal requirements. We will post the updated Terms here and, when appropriate, notify you via the service or email. Continued use after changes means you accept them.
